Clarity Pool Service Terms of Service

Clear terms for recurring pool service, scheduling, billing, holidays, weather, repairs, and customer responsibilities.

These Terms of Service apply to recurring pool and spa maintenance services provided by Clarity Pool Service (“Clarity,” “we,” “us,” or “our”).

By beginning service, signing a Clarity Pool Service Agreement, or otherwise accepting recurring service, the customer (“Customer,” “you,” or “your”) agrees to these Terms of Service.

Your individual Service Agreement may contain customer-specific pricing, service details, special instructions, and other terms. If a customer-specific provision in your signed Service Agreement conflicts with these Terms of Service, the signed Service Agreement will control for that specific provision.


1. Month-to-Month Service

Clarity Pool Service provides recurring pool maintenance on a month-to-month basis unless otherwise stated in writing.

There is no long-term service commitment.

Service continues month-to-month until canceled by either Clarity or the Customer in accordance with these Terms.


2. Service Frequency

Regular pool service is normally provided once per week on the Customer’s assigned route day.

Clarity will make reasonable efforts to maintain a consistent service day, but a particular day or arrival time is not guaranteed.

Service schedules may change because of:

  • Holidays

  • Weather

  • Route adjustments

  • Staffing

  • Traffic

  • Emergencies

  • Equipment or vehicle issues

  • Other operational circumstances

When necessary, service may be performed on a different day during the same service week.


3. 48-Visit Annual Service Structure

Clarity’s recurring monthly service pricing is based on 48 scheduled service visits per year.

The monthly rate is calculated using approximately four service visits per month and divided into 12 equal monthly payments.

Because a calendar year contains approximately 52 weeks, some months contain five potential weekly service days.

Customers are not charged an additional amount for five-week months.

The remaining calendar weeks allow Clarity to account for planned non-service weeks, holidays, illness, severe weather, vacation, training, emergencies, and other operational interruptions.

The Customer’s regular monthly rate therefore remains the same regardless of whether a particular month contains four or five potential weekly service days.


4. Floating Non-Service Weeks

Clarity may designate up to four non-service weeks per calendar year.

These weeks may be used for:

  • Vacation

  • Holidays

  • Illness

  • Severe weather

  • Training

  • Emergencies

  • Operational interruptions

  • Other reasonable business needs

Whenever reasonably possible, Clarity will provide advance notice of planned non-service weeks.

These non-service weeks are already accounted for in the 48-visit annual service structure and do not result in an automatic billing credit or reduction.

A holiday week may also be designated as one of Clarity’s floating non-service weeks.


5. Observed Holidays

Clarity Pool Service observes the following holidays:

  • New Year’s Day

  • Presidents Day

  • Memorial Day

  • Independence Day

  • Labor Day

  • Thanksgiving Day

  • Christmas Day

Regular route service is not performed on an observed holiday.

When an observed holiday falls on a Customer’s normal service day during an otherwise active service week, Clarity may perform the affected service on an alternate day during that same week.

Alternate service may occur before or after the normal route day based on scheduling and operational conditions.

A specific alternate day or arrival time is not guaranteed.

If Clarity designates the entire holiday week as one of its annual floating non-service weeks, regular service will not be performed during that week.


6. Weather and Unsafe Conditions

Pool service is performed outdoors and may be affected by rain, wind, lightning, flooding, extreme temperatures, poor visibility, unsafe surfaces, or other hazardous conditions.

During light or moderate weather, Clarity may provide regular or abbreviated service depending on conditions.

During severe or unsafe weather, Clarity may:

  • Test and balance water chemistry

  • Add necessary chemicals

  • Empty accessible baskets

  • Inspect visible equipment

  • Perform abbreviated cleaning

  • Reschedule the visit

  • Perform service on an alternate day

  • Omit the visit when safe service is not practical

Vacuuming, brushing, skimming, or other physical cleaning may be reduced or postponed when conditions prevent those services from being completed safely or effectively.

Weather-related service interruptions are accounted for within the annual service structure and do not automatically result in a credit or refund.


7. Regular Weekly Service

Regular weekly pool service may include, depending on the Customer’s service plan and pool conditions:

  • Testing pool water

  • Balancing routine water chemistry

  • Adding normal maintenance chemicals as needed

  • Skimming the pool surface

  • Brushing pool walls, steps, benches, tile, and appropriate surfaces

  • Vacuuming as needed

  • Emptying skimmer baskets

  • Emptying the pump basket when appropriate and accessible

  • Checking visible pool equipment for normal operation

  • Notifying the Customer of observed maintenance or equipment concerns

Specific service tasks may vary based on pool condition, weather, season, accessibility, equipment, and customer-specific service instructions.


8. Customer-Specific Service Instructions

Some customers may have special service instructions that differ from Clarity’s standard weekly service.

Examples may include:

  • Vacuuming on a specific frequency

  • Special access instructions

  • Specific gate requirements

  • Customer-supplied products

  • Specific pool or spa maintenance instructions

Customer-specific service instructions should be documented in the Customer’s Service Agreement or account record.

When customer-specific written instructions differ from Clarity’s normal service routine, those instructions will control to the extent reasonably possible.


9. Property Access

The Customer is responsible for providing safe and reasonable access to the pool and pool equipment on the scheduled service day.

This includes providing:

  • Current gate codes

  • Lock combinations

  • Keys when necessary

  • Security or access instructions

  • Clear access to the pool

  • Clear access to pool equipment

If Clarity cannot access the service area because of a locked gate, incorrect code, inaccessible equipment, construction, unsecured pet, or another Customer-controlled condition, service may not be performed.

A return visit is not guaranteed.

The Customer will not normally receive a credit for a visit missed because Clarity was unable to access the property due to a Customer-controlled access issue.


10. Pets

The Customer is responsible for properly securing dogs and other animals that may interfere with safe service.

Customers should notify Clarity of pets that may be present in the service area.

Clarity will make reasonable efforts to properly close gates and access points after service.

However, the Customer remains responsible for containing and securing animals on the property.

Clarity may decline to enter a property or service area when an animal presents a safety concern.


11. Customer Responsibilities

The Customer is responsible for maintaining conditions necessary for routine pool service.

This includes:

  • Maintaining an appropriate pool water level

  • Maintaining functioning circulation equipment

  • Providing electrical power to pool equipment

  • Providing safe access to the pool and equipment

  • Keeping the equipment area reasonably clear

  • Informing Clarity of known leaks or equipment failures

  • Informing Clarity of construction or landscaping that may affect the pool

  • Removing pool covers, large toys, floats, or other items that prevent normal service when necessary

Clarity is not responsible for pool conditions caused by inadequate water level, equipment failure, power outages, leaks, excessive debris, landscape runoff, construction, vandalism, unusual swimmer load, pets, or other conditions outside Clarity’s reasonable control.


12. Filter Cleaning

Periodic filter cleaning is not included in the standard recurring monthly service rate unless expressly stated in the Customer’s Service Agreement.

Filter cleaning may be recommended or performed based on:

  • Filter pressure

  • Filter type

  • Pool conditions

  • Seasonal use

  • Manufacturer recommendations

  • Clarity’s maintenance assessment

Filter cleaning is billed separately at the Customer’s agreed rate or Clarity’s current applicable rate.

When practical, the Customer will be notified before a separately billed filter cleaning is performed.


13. Salt Cell Cleaning

Salt-water pools may require periodic salt-cell inspection and cleaning.

Routine visual inspection may be included in normal service.

Physical cleaning, descaling, or other maintenance of the salt cell may be billed separately unless specifically included in the Customer’s service plan.


14. Routine and Specialty Chemicals

Routine chemicals required for normal weekly maintenance are handled according to the Customer’s selected service plan.

Additional charges may apply for specialty chemicals, extraordinary chemical demand, or corrective treatments resulting from unusual pool conditions.

Examples may include:

  • Algae treatments

  • Phosphate removers

  • Stain and scale products

  • Conditioner or stabilizer

  • Salt

  • Enzymes

  • Clarifiers

  • Specialty sanitizers

  • Excessive chlorine or acid requirements

  • Corrective treatment resulting from leaks, equipment failure, heavy swimmer load, pets, excessive debris, or similar conditions

When practical, Clarity will notify the Customer before performing a material separately billed treatment.


15. Repairs and Replacement Parts

Repairs, replacement parts, and equipment installation are not included in the recurring monthly service rate unless specifically stated otherwise.

Customers may authorize Clarity to perform minor repairs up to a predetermined dollar amount without additional approval.

The authorized amount, if applicable, will be shown in the Customer’s Service Agreement.

Examples of minor maintenance items may include:

  • O-rings

  • Skimmer baskets

  • Pump baskets

  • Weir doors

  • Cleaner bags

  • Floaters

  • Other similar maintenance items

Repairs exceeding the Customer’s approved authorization amount require approval before work is performed, except where emergency authorization has been separately provided.


16. Excessive Debris and Additional Cleanup

Normal debris removal associated with routine weekly pool service is included.

Additional charges may apply when cleanup requires substantially more labor or chemicals than a normal service visit.

Examples include:

  • Major storm debris

  • Excessive landscaping debris

  • Construction debris

  • Vandalism

  • Large amounts of leaves or organic matter

  • Pools left in abnormal or neglected condition

  • Cleanup following equipment failure

  • Unusual environmental events

Clarity will communicate additional cleanup charges when reasonably practical.


17. Additional Service Calls

Additional visits requested by the Customer outside the normal recurring service schedule may be billed separately.

Examples include:

  • Party preparation

  • Post-party cleanup

  • Emergency service

  • Extra vacuuming

  • Additional chemical treatment

  • Equipment troubleshooting

  • Special cleaning requests

Pricing for additional service calls may vary based on the work required.


18. Initial Pool Condition

Recurring weekly service assumes the pool is in a reasonably clean, clear, and maintainable condition when regular service begins.

If a pool requires significant corrective work before normal weekly service can begin, Clarity may recommend or require an initial cleanup, chemical correction, algae treatment, or other restorative service.

Initial corrective services may be billed separately.


19. Billing

Recurring pool service is billed monthly in advance for the current service month unless otherwise agreed in writing.

The monthly rate is based on the 48-visit annual service structure and remains consistent throughout the year.

The first month of service may be prorated based on the Customer’s service start date.

Additional services, repairs, parts, filter cleaning, specialty chemicals, and other separately billed items may appear on the Customer’s regular invoice or a separate invoice.


20. Payment and Past-Due Accounts

Invoices are due according to the payment terms shown on the Customer’s invoice or Service Agreement.

If an account becomes past due, Clarity may:

  • Send payment reminders

  • Suspend recurring service

  • Cancel service

  • Require payment before service resumes

If service is interrupted because of nonpayment and the pool requires additional cleaning, chemicals, or corrective treatment before normal service can resume, those services may be billed separately.

Any applicable late fees, returned-payment fees, or other payment charges will be disclosed in the Customer’s Service Agreement, invoice, or payment terms.


21. Rate Changes

Clarity may adjust recurring service rates when reasonably necessary due to changes in:

  • Chemical costs

  • Labor costs

  • Fuel or operating expenses

  • Pool condition

  • Service requirements

  • Equipment requirements

  • Regulatory costs

  • Other material business conditions

Clarity will provide advance notice before a recurring rate change becomes effective.

Customers who do not wish to continue service at the new rate may cancel their month-to-month service.


22. Pool and Equipment Conditions

Pool cleanliness and water chemistry can be affected by factors outside Clarity’s control.

These may include:

  • Weather

  • Swimmer load

  • Pets

  • Landscaping

  • Poor circulation

  • Equipment failure

  • Leaks

  • Water quality

  • Power outages

  • Construction

  • Chemical demand

  • Environmental contaminants

Clarity does not guarantee that a pool will remain completely free of debris, algae, staining, scale, or other conditions between weekly service visits.

Equipment checks performed during regular pool service are limited visual and operational observations and are not comprehensive mechanical, electrical, plumbing, structural, or leak inspections.


23. Communication

Customers are responsible for maintaining current contact information with Clarity, including phone number, email address, service address, billing information, and access instructions.

Clarity may communicate with customers regarding:

  • Scheduled service

  • Service changes

  • Pool conditions

  • Equipment concerns

  • Repairs

  • Billing

  • Account administration

  • Customer-care matters

Text message consent and marketing communications are handled according to applicable consent requirements and the Customer’s communication preferences.


24. Cancellation

Recurring service is month-to-month.

Either the Customer or Clarity Pool Service may cancel recurring service.

There is no long-term cancellation penalty.

The Customer remains responsible for:

  • Service already provided

  • Outstanding monthly service charges

  • Approved repairs

  • Parts

  • Additional services

  • Other outstanding account balances

Cancellation requests may be submitted using the cancellation methods made available by Clarity.

Where required by applicable law, customers who entered into service electronically will be provided an electronic method of cancellation.


25. Changes to These Terms

Clarity may update these Terms of Service from time to time.

Material changes affecting recurring service, billing, or Customer obligations will be communicated when required.

The version of the Terms associated with the Customer’s Service Agreement will apply unless subsequently modified in accordance with applicable law and Customer notice requirements.
